The Court of Appeals announced a new decision today in People v. Kolupa (Ct. App. 9/22/2009) (SSM), finding that the defendant failed to preserve his claim that the People did not corroborate a child victim's testimony. Although a motion to dismiss was made at the close of the People's case, the defendant went on to present his own evidence but did not renew his original motion.
