Release of PSR to defendant denied

Often, a defendant serving a prison sentence will seek to obtain a copy of his or her presentence report in order to prepare for a parole hearing or litigate a claim on direct or collateral review.  Justice DiMango of Brooklyn Supreme Court recently issue an opinion in People v. Johnson that gives a good overview of the law on the subject.  The court concluded that release of the PSR in the defendant's case was not warranted.
