Depraved Indifference Murder Watch

Last week, the Fourth Department reversed a defendant's murder conviction because the evidence was not legally sufficient to establish that he acted with depraved indifference.  Citing Matter of Suarez v. Byrne, the court remanded for a new trial on the counts that the jury did not reach.  The case is People v. Lagasse (4th Dept. 11/14/2008).  (LC)
